Too Small and packaging had been opened up. Used clothing??

I like the material and the construction and design but I have two issues with this product. First they were really small and not true to size. I usually get a Large in something like this but this was so so small in every way.
Secondly the retail package they came in had obviously already been opened up and possibly worn before. So, is Amazon now selling previously worn clothing?? That's disappointing and disgusting!!
